Hamilton IP Law Leads Successful Patent Defense for Genesis III, Inc.

Hamilton IP Law (www.hamiltoniplaw.com) – Registered U.S. Patent Attorneys based in Davenport and Iowa City, IA – have successfully represented Genesis III, Inc. (www.g3hammers.com) of Prophetstown, IL during a recent inter parties review (IPR) before the Patent Trial and Appeal Board (PTAB) at the U.S. Patent and Trademark Office.

The case defended U.S. Patent No. 7,140,569 (‘569 Patent), owned by Genesis III, against a challenge to the validity of its claims covering forged hammers used in grain and feed material milling and grinding systems. According to Hamilton IP Law, the ‘569 Patent has been successfully asserted previously in various litigation cases against other manufacturers including Jacobs Corporation and Black Diamond.

Hamilton IP Law opposed the institution of the IPR against Genesis III’s ‘569 Patent. On January 22, 2015, in Jacobs Corporation v. Genesis III, Inc. the PTAB denied the IPR petition in all respects, finding that it failed to demonstrate a reasonable likelihood that any of the challenged claims would be held invalid under any of several proposed theories, according to Hamilton IP Law.

Bakko Brothers, Inc. of Glenwood, MN (www.bakkobros.com), as an exclusive licensee under the ‘569 Patent and other related patents, and Genesis III, are currently involved in a patent infringement lawsuit against Jacobs Corporation in the U.S. District Court for the Southern District of Iowa (Case 4:14-cv-00015).
